This Website Privacy and Cookie Policy Clarification Text (“Clarification Text”) has been prepared by TÜNAŞ, which is the data controller pursuant to the Personal Data Protection Law No. 6698 (“LPPD”) regarding the use of personal data obtained from Personal Data Owners who visit the website, during the use of the website owned and managed by TÜNAŞ, in order to inform and clarify you in a transparently about the ways of collecting your personal data, the purposes and legal reasons of personal data processing activities, the principles regarding the transfer of personal data, if transferred, and your legal rights as the data owner. If the website is used, this Clarification Text shall be deemed to have been notified to you.

TÜNAŞ may update and change the provisions of this Clarification Text at any time by publishing it in other places. Updates and changes made by TÜNAŞ shall be valid from the date of publication.

In accordance with the LPPD, your personal data may be collected and processed by the Company that is considered as the Data Controller, within the scope specified below.

2. PURPOSE OF PROCESSING PERSONAL DATA ON THE INTERNET

TÜNAŞ processes your personal data subject to the Clarification Text for the purposes of executing information security processes and executing access authorizations, within the scope of the personal data processing conditions and purposes specified in the Articles 5 and 6 of the LPPD.

3. METHOD AND LEGAL REASON FOR COLLECTING PERSONAL DATA

Your Personal Data is processed by TÜNAŞ, within the scope of your visit to our website, through the following channels, in accordance with the basic principles stipulated by the LPPD, through cookies in the electronic media, based on legal reasons that it is necessary for the legitimate interests of TÜNAŞ;

• website visits.

4. WHO HAVE ACCESS TO THE INFORMATION OBTAINED BY PROCESSING THE DATA RECEIVED ON THE INTERNET AND TO WHOM THIS INFORMATION IS TRANSFERRED

Authorized people of TÜNAŞ have access to digitally recorded and preserved records. People, who have access to the records, declare with a confidentiality commitment that they will protect the confidentiality of the data they access.

Information that recorded and preserved in the digital media is shared with the judicial bodies, legally authorized public institutions and organizations and third parties in accordance with the procedures and principles specified in the laws.

TÜNAŞ shall not disclose the Personal Data it obtains to others in a way that is contrary to Clarification Text and shall not use it other than  processing purposes.

5. ENSURING THE SECURITY OF THE DATA OBTAINED BY TÜNAŞ THROUGH THE DATA PROCESSING ON THE INTERNET AND THE STORAGE PERIOD

TÜNAŞ, in accordance with the Article 12 of the LPPD, in order to ensure that;

• Personal data is not processed unlawfully,
• Personal data is not accessed unlawfully,
• The protection of personal data,

TÜNAŞ undertakes to take the necessary technical and administrative measures to ensure the appropriate level of safety and to carry out the necessary inspections. The information, obtained through the data processing activity received on the internet is stored by TÜNAŞ for a period of 1 (one) month.

6. TYPES OF COOKIES

6.1. FIRST PARTY COOKIES:

First-party domains are sent only to the relevant site, for each web page you request from your computer.

The website may recognize you both during your visit and on subsequent visits. For this reason, it is not possible to use the internet practically with a browser with first-party cookies turned off.

The personal data subject to this clarification text is kept accessible only to limited people  within TÜNAŞ. At the end of the processing period, this personal data will be deleted, destroyed or anonymized as shown in TÜNAŞ's Personal Data Processing, Storage and Disposal Policy.

11. RIGHTS AND OBLIGATIONS OF THE PERSONAL DATA OWNER

Within the scope of LPPD and related legislation, the Personal Data Owners have the following rights:

• Learning whether your personal data has been processed,
• Requesting information if your personal data has been processed, about it,
• Learning the purpose of processing your personal data and whether they are used appropriately,
• Learning the third parties to whom your personal data has been transferred domestically or abroad,
• Requesting the correction of your personal data in case of incomplete or incorrect processing, and requesting the notification of the transaction made within this scope to the third parties to whom your personal data has been transferred,
• Requesting the deletion or destruction of your personal data in case the reasons requiring the processing of your personal data become invalid, and requesting the notification of the transaction made within this scope to the third parties to whom your personal data has been transferred,
• Objecting to the emergence of a result against you by analyzing your processed data exclusively through automated systems,
• Requesting the recovery of the damage in case you suffer damage due to unlawful processing of your personal data.

On the other hand, you are responsible for ensuring that the personal data you share with TÜNAŞ is correct, complete and up-to-date, and if you share personal data of other people, this data is valid and in accordance with the legislation. In addition, you are obliged to inform the third parties whose personal data you have provided to TÜNAŞ about the content of this Clarification Text and to obtain their consent for the use of their personal data by TÜNAŞ as specified in this Clarification Text (including transfer and explanation).

As Personal Data Owners, you can send your application, which includes your requests regarding your rights, in a clear and agreeable manner, by attaching the documents identifying your identity and address information, in writing and with wet signature, by hand, by post or via notary public to the address “İşçi Blokları Mah. While the company has the right to verify your identity before responding, your application must include the following information:

• Your name, surname andyour signature if the application is written;
• If you are a citizen of the Republic of Türkiye, your TC identity number; if you are a foreigner, your nationality, your passport number or your identity number if you have one;
• Your place of residence or workplace address for notification;
• (If possible) your e-mail address, telephone and fax number, for notification;
• Your subject of the request.  

If applicable, information and documents related to the subject must be attached to the application. If you submit your requests to the Company as stated above, the Company shall finalize the request as soon as possible and within thirty days at the latest, depending on the nature of the request.
